Xpress Color Bar Membership Terms and Conditions
Effective Date: April 1, 2025

These Membership Terms and Conditions (the “Terms”) govern the use of the Xpress Color Bar Membership Program offered by The MARC Advanced Color & Salon (“The MARC,” “we,” “our,” or “us”) to individuals (“you” or “Member”) who purchase a Luxe or D’ Luxe Membership. By enrolling in the Membership Program, you agree to be bound by these Terms and our general Terms of Service and Privacy Policy, each of which is incorporated herein by reference.

BY AGREEING TO THE XPRESS HAIR COLOR AND TERMS AND ELECTING TO PURCHASE A MEMBERSHIP, YOU ACKNOWLEDGE THAT YOUR MEMBERSHIP HAS RECURRING PAYMENT FEATURES AND YOU ACCEPT RESPOSIBILITY FOR ALL RECURRING PAYMENT OBLIGATIONS PRIOR TO CANCELLATION OF YOUR MEMBERSHIP BY YOU OR THE MARC ADVANCED COLOR & SALON. YOUR MEMBERSHIP CONTINUES UNTIL CANCELLLED OR WE TERMINATE YOUR ACCESS TO OR USE OF THE SERVICES OR MEMBERSHIP IN ACCORDANCE WITH XPRESS COLOR BAR TERMS OF SERVICE AS APPLICABLE.

By enrolling in or using the Xpress Color Bar Membership Services (“Services”) offered by The MARC Advanced Color & Salon, you agree to be bound by these Xpress Color Bar Membership Terms, along with any other agreements incorporated herein by reference, including The MARC Terms of Service and The MARC Privacy Policy, each of which is made available upon request and at www.atthemarc.com

To the extent that any conflicts arise between these Xpress Color Bar Membership Terms and any other general terms or agreements with The MARC, these Membership Terms shall prevail solely with respect to the specific aspects of the Xpress Color Bar Services.

You may enroll in and use the Luxe or D’ Luxe Membership only if you are at least eighteen (18) years of age, have the legal capacity to enter into a binding agreement with The MARC, and are not otherwise prohibited from participating in such services under applicable law.

  1. Membership Tiers & Description

Luxe Membership
Includes one in-salon root touch-up every 6 weeks. Unused services do not roll over. This membership is designed for those seeking regular maintenance with in-salon color services only.

D’ Luxe Membership
Includes unlimited in-salon root touch-up appointments while membership is active, subject to availability and booking policies. If a Member is unable to attend an in-salon appointment during a billing cycle, they may instead pick up one (1) color kit for at-home application (Coming Soon). Kits must be picked up in person at The MARC Advanced Color & Salon during business hours. This benefit is limited to one kit per billing cycle and does not roll over if unused.

  1. Billing and Payment

Membership fees are billed automatically every 28 days (“Billing Cycle”) to the payment method on file. Applicable taxes, product surcharges, or add-ons may be charged separately at the time of service or product pickup.

Product Usage Note:
Additional product charges may apply if your service requires more than the standard amount of color due to hair length, thickness, or texture. We may add, remove, or otherwise modify the list of services, benefits, or products available to you under your D’ Luxe Membership at any time. Any such changes will be communicated either by updating these Xpress Color Bar Membership Terms, or through notices posted in the Xpress Color Bar FAQs, which are available in-salon and at www.atthemarc.com


  1. Cancellation Policy

You may cancel your Membership as follows:

Initial Cancellation Window:
You may cancel your membership within two (2) business days of your original sign-up date for a full refund, provided that no service or product has been used or picked up during that time.

After Initial Period:
All sales are final for the active Billing Cycle. If you cancel after the initial two-day window, your membership will remain active through the end of the current Billing Cycle and will not be renewed for the following cycle. No prorated refunds will be issued.

Minimum Commitment:

  • Luxe Membership: Requires a minimum commitment of three (3) Billing Cycles before cancellation may be processed. Cancellation requests prior to fulfilling the three-cycle minimum will not be accepted.
  • D’ Luxe Membership: Requires a minimum commitment of three (3) Billing Cycles before cancellation may be processed. Cancellation requests prior to fulfilling the three-cycle minimum will not be accepted.

  1. How to Cancel

Cancellations may be submitted in one of the following ways:

  • By phone: (925) 947-2800
  • In person: At the front desk of The MARC Advanced Color & Salon
  • By email: customerservice@atthemarc.com (subject line: “Membership Cancellation Request”)

  1. Pausing Membership (D’ Luxe Only)

Members enrolled in the D’ Luxe Membership may pause their membership once per 12-month period for up to two (2) consecutive Billing Cycles (i.e. 56 days). While paused:

  • No membership charges will be incurred
  • No in-salon services or at-home kits will be available
  • Membership will automatically resume after the pause period unless canceled beforehand

A reminder will be emailed 10 days before the automatic resumption.

  1. Modifications

The MARC reserves the right to modify or update these Terms, membership services, or pricing at any time. Members will be notified in advance of any material changes. Continued use of the Membership after such updates constitutes agreement to the revised Terms.
